Timberaul Transformation Terms & Conditions

1. The promoter is Stegbar Pty Limited ABN 52 007 090 820, of Level 3, 78 Waterloo Rd, Macquarie Park, NSW, a subsidiary of Ventora Australia Pty Limited (the Promoter).
2. Information/Instructions on how to enter this promotion forms part of these conditions. Entry into this promotion will be deemed as acknowledgement and acceptance by you of these terms and conditions governing this promotion. This promotion is not valid in conjunction with any other offer.
3. This promotion commences on the 7^th of October 2024 at 9am (AEDST) and concludes on the 16^th of December 2024 at 11.59pm (AEDST) (Promotion Period). All times and dates referenced throughout these terms and conditions will be based on Sydney local time, which will be either AEST or AEDST, depending upon the date and time.

PRIZE

4. There is one major prize to be awarded from all entries received throughout the Promotion Period.

• The major prize is valued at up to AU$20,000.00 (inclusive of applicable taxes) and is to be taken as Timberaul window or door products available in the range as at the 1^st of October 2024. The value of this prize will include installation and delivery fees (i.e. the value of part of the $20,000 prize will have an installation and delivery fee component to cover these associated costs).

• The Promoter will liaise with the winner to organise exactly what Stegbar Timberaul products the winner wishes to receive, subject to availability, and will organise the supply and installation of that product, within the allocated major prize value.
• The winner has the following options for Timberaul windows and doors, within the standard product offering available to Timberaul as of the 1^st of October 2024:
  • Glazing
  • Hardware
  • Species
  • Finishes
• The prize does not include other products within the Stegbar range (e.g., showers, wardrobes, aluminium windows and doors) or outside of the available range of Stegbar products.
• The Timberaul products selected by the winner can only be used at the winner’s residential property, which must be located in a participating State and area, which Stegbar service -refer to clause 10 for further details. If the winner moves house after entering to an area that is not serviced by Stegbar, then they may be declared ineligible to receive the prize, at the absolute discretion of the Promoter.
• The Promoter will not be responsible for any required government approvals, the acts or omissions of any third parties, including any builders, or if the site for installation of the product is not built to a reasonable standard to allow installation (e.g., the door/window openings are not square).
• If the winner’s residential address is jointly owned with another party, the winner warrants that they have sought that party’s approval to take the prize as selected by the winner.
• Product/installation can be used in a new home construction or as part of a renovation.
• The entire AU$20,000 prize is to be used at one address and cannot be used over multiple addresses.
• In the event that the winner’s chosen material (including delivery and installation) is valued at less than AU$20,000, the remainder of the prize value will be forfeited by the winner and will not be awarded as cash or substituted with any other Stegbar product. If the winner wishes to choose material in excess of the major prize value (inclusive of delivery, installation and applicable taxes), they can do so, however, the winner will then be required to pay for any cost over the major prize value.
• In the event that agreement cannot be reached between the Promoter and any winner (in relation to the exact material or installation and delivery timelines), within one month after being confirmed by the Promoter, despite reasonable efforts from the Promoter, or if the winner is unable to or refuses to have or accept the materials, installation and/or delivery at their property for any reason or refuses to agree to any reasonable condition of accepting the prize, the Promoter reserves the right, in its absolute discretion, to invalidate such a winner and deem the entire prize (i.e. elements outlined under the ‘Prize’ heading) to be forfeited by the winner.
• The prize is taken subject to Stegbar’s standard terms and conditions that relate to the supply, delivery and installation of Stegbar product, as if the prize was being paid for by the winner.
• Installation needs to be within the capability of Stegbar's current service offer. Stegbar will provide brick cutting for sill bricks. Any painting, structural and brickwork will need to be completed by another builder after install. It is up to prize winner to remove and replace any window furnishings. HOW TO ENTER THIS PROMOTION

1. To enter this promotion, the eligible entrants must, during the Promotion Period, go online at www.Stegbar.com.au/Timberaul-Competition (Website) and:

• Follow the prompts and input the requested details, including their full name, valid email address, phone number and postcode;
• Answer the relevant home/renovation questions;
• Agree to the promotion terms and conditions; and
• Submit the completed entry form.

1. The Promoter’s decision in relation to any aspect of the promotion will be final and binding on every person who enters. No correspondence will be entered into.
2. The draw will take place at 2.00pm AEDST on the 19^th of December 2024 at Communicado, Level 1/554 High Street Prahran, Vic. The winner will be notified by email and phone within five working days of the draw date, and their first initial,  surname, and postcode will be published on the Website on the 23^rd of December 2024. The Promoter reserves the right to draw and use those reserves if the original person selected or any subsequent reserve is deemed ineligible after being contacted or is uncontactable after several reasonable attempts by the Promoter to confirm their eligibility to receive the prize. Limit one entry per eligible entrant and one entry per household.
3. The use of any automated entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
4. The Promoter accepts no responsibility for any entries not received by the Promoter or delays due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the entrant.

ELIGIBILITY

1. This promotion is only open to 18-year-old residents of Australia who own (or jointly own) a residential property in SA, Victoria, the Australian Capital Territory, New South Wales or South East Queensland (excluding Northern Queensland), where the prize can be installed in accordance with Stegbars’ standard delivery/ installation requirements/areas. For Stegbar’s showrooms visit https://www.stegbar.com.au/find-a-showroom/. Stegbar’s service areas are typically within a 75 km radius of a showroom, but maybe a greater radius in some instances. The Promoter will check the person selected in a draw, unclaimed draw or as a reserve (as the case requires), in order to determine if they’re eligible to take the prize.
2. Promotion is not open to employees, contractors or subcontractors (or immediate family members) of Stegbar Australia Pty Ltd, Ventora Australia Pty Ltd, or any subsidiary entities.
3. Subject to the winner complying with these terms and conditions:
1. The prize will be delivered to the residential address nominated by the winner and notified to the Promoter;
2. The Promoter will endeavour to supply and install the prize at the winner’s eligible residential address between the 1^st of February 2025 and the 1^st of October 2025, subject to booking and availability; and
3. Products not installed or supplied before the 1^st of October 2025, at no fault of the Promoter, will be forfeited by the winner.
4. Incomplete, indecipherable or ineligible entries will be deemed invalid. Eligible entrants are responsible for ensuring their correct contact details and residential address details are provided and any updated details are notified to the Promoter. The Promoter accepts no responsibility should an eligible entrant fail to receive their selected Timberaul products because of a failure to notify the Promoter of correct details or of a change to those details.
5. All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
6. The Promoter reserves the right, at any time, to verify the validity of entries or entrants (including name, age, and address) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions, who tampers with the entry process, or the Promoter (acting reasonably) deems to participate in a way that impacts upon the fair and proper conduct of the Promotion. The Promoter’s decision is final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors or omissions may be accepted at the absolute discretion of the Promoter.
7. A person selected (or a reserve, as applicable) in the original prize draw must claim the prize before 12pm on the 27^th of February 2025. The unclaimed prize draw, if required, will take place at the same time and place as the original draw on the 28^th of February 2025, subject to any directions from a regulatory authority. The winner, if any, will be contacted by phone and email within 7 days of the draw, and the winner’s first initial, surname and postcode will be published on the Website on the 7^th of March 2025. The Promoter reserves the right to draw and use those reserves if the original person selected in the unclaimed prize draw or any subsequent reserve is deemed ineligible after being contacted or is uncontactable after several reasonable attempts by the Promoter to confirm their eligibility to receive the prize.
8. The prize (including Timberaul products) or any unused portion of the prize must be taken as stated. It cannot be redeemed for cash, substituted/swapped for other products offered by the Promoter or transferred to another person unless the Promoter permits otherwise in its sole discretion.
9. If the prize (or part of the prize) becomes unavailable for reasons beyond the reasonable control of the Promoter, the Promoter, at its sole discretion, reserves the right to substitute for an alternative prize of equivalent value and specification, subject to any written directions from a regulatory authority.
10. The Promoter reserves the right to change any terms contained in these terms and conditions at any time, subject to any written directions from a regulatory authority. Changes to terms and conditions will be available on the Website.
11. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
12. Except for any liability that cannot be excluded by law, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in the  value to that stated in these terms and conditions; (d) any tax liability incurred by a winner or entrant; or (e) use of the prize.
13. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (CCA) or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the terms and conditions or provides statutory guarantees in connection with these terms and conditions, in respect of goods and services supplied, the Promoter’s liability for breach of such a condition, warranty, other term or guarantee is limited (as the Promoter’s sole election) to the extent it is able to do so: (a) in the case of supply of goods, the Promoter doing any one or more of the following: (i) replacing the goods or supplying equivalent goods; (ii) repairing the goods; (iii) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (iv) paying the cost of having the goods repaired; or (b) in the case of supply of services; the Promoter doing either or both of the following: (i) supply the services again; and/or (ii) paying the cost of having the services supplied again.
14. It is a condition of taking the prize that the winner may be required to sign a legal release and indemnity in a form determined by the Promoter.
15. All entries become the property of the Promoter. The Promoter may collect personal information about you in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, services providers, offer suppliers and, as required to Australian regulatory authorities. All entrants consent to their personal information being collected and stored for the purposes of administering the Promotion in accordance with the Promoter’s privacy policy available at  https://www.stegbar.com.au/about/privacy-policy/ which forms part of these terms and conditions. If you fail to provide your personal information, you may not be permitted to enter. The Promoter is committed to maintaining your privacy, and we want you to understand how we use and manage your data. By supplying the Promoter your information, you have given us permission to communicate to you via mail, e-mail, SMS, MMS, Facebook, Instagram and telephone indefinitely to inform you about products and services we deliver relevant, unless you advise otherwise. You should direct any request to access, update, and correct information or to opt-out of receiving marketing material to the Promoter. Personal information will not be disclosed outside of Australia.
